Article 1 – Definitions

In these Terms and Conditions the following definitions apply:

Consumer: a natural person who is not acting for purposes related to their trade, business, craft or profession.

Entrepreneur: Spare Parts Holland B.V.

Distance contract: an agreement concluded between the entrepreneur and the consumer within the framework of an organized system for the distance sale of products.

Reflection period: the period within which the consumer can exercise the right of withdrawal.

Products: spare parts and related items offered via the webshop.

Article 3 – Applicability

These Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer.

If specific product or service conditions apply in addition to these Terms and Conditions, the most favorable provision for the consumer will apply in case of conflicting conditions.


Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.

The offer contains a complete and accurate description of the products offered.

Images and product descriptions are intended to provide a realistic representation of the products. Minor variations may occur.

Obvious mistakes or errors in the offer do not bind the entrepreneur.


Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and complies with the stated conditions.

The entrepreneur confirms receipt of the order electronically.

The entrepreneur reserves the right to refuse orders or attach additional conditions.


Article 6 – Right of Withdrawal

Consumers within the European Union have the right to withdraw from the agreement within 14 days after receiving the product, without giving any reason.

After notifying the return, the consumer has an additional 14 days to return the product.


Article 7 – Obligations of the Consumer During the Reflection Period

During the reflection period the consumer shall handle the product and packaging with care.

The consumer may only unpack or use the product to the extent necessary to determine the nature, characteristics and functioning of the product.

The consumer is liable for any diminished value of the product resulting from handling beyond what is necessary for inspection.


Article 8 – Exercise of the Right of Withdrawal and Costs

If the consumer exercises the right of withdrawal, the consumer must notify the entrepreneur within the reflection period.

The consumer must return the product within 14 days after notification.

The direct costs of returning the product are borne by the consumer unless otherwise agreed.


Article 9 – Obligations of the Entrepreneur in Case of Withdrawal

The entrepreneur will refund all payments received from the consumer within 14 days after receiving the withdrawal notification.

The entrepreneur may wait with reimbursement until the returned goods have been received or proof of return has been provided.

Refunds will be made using the same payment method used by the consumer unless otherwise agreed.


Article 10 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for products that:

• are custom made or ordered specifically for the customer
• cannot be returned for hygienic or technical reasons once used
• have been installed, mounted, or used

Installed or used spare parts cannot be returned.

Parts that are specifically ordered for a customer or are not part of the regular stock assortment cannot be returned.


Article 11 – The Price

During the validity period stated in the offer, prices will not be increased except for VAT changes or legal requirements.

All prices displayed on the website include VAT unless stated otherwise.

The entrepreneur reserves the right to change prices.


Article 12 – Compliance with the Agreement and Warranty

The entrepreneur guarantees that the products comply with the agreement and the reasonable requirements of reliability and usability.

Normal wear, incorrect installation, misuse, or use outside the intended application are not covered by warranty.


Article 13 – Delivery and Execution

The entrepreneur will take the greatest possible care in processing and executing orders.

Delivery will take place at the address provided by the customer.

The entrepreneur strives to ship orders as quickly as possible.

The entrepreneur is not responsible for delays caused by shipping carriers or circumstances beyond its control.


Article 14 – Duration Transactions: Duration, Cancellation and Renewal

Consumers may terminate agreements that extend to the regular delivery of products at any time with a notice period of one month.

If a contract has a fixed duration, it will automatically end at the agreed end date unless otherwise stated.


Article 15 – Payment

Payment must be made using the payment methods offered in the webshop.

The entrepreneur may suspend or cancel orders if payment is not successfully completed.


Article 16 – Complaints Procedure

Complaints about the execution of the agreement must be submitted within a reasonable time after the defect has been discovered.

The entrepreneur will respond to complaints within 14 days.


Article 17 – Additional or Deviating Provisions

Additional provisions or deviations from these Terms and Conditions may not be to the detriment of the consumer and must be recorded in writing.


Important Compatibility Notice

Customers are responsible for verifying that the ordered part is compatible with their machine or intended application.

Installation of a part constitutes confirmation that the part is suitable for the intended use.

Once installed, parts are considered accepted and cannot be returned.
